Peter Yeldham

Peter is a Partner in the Dispute Resolution group in the Sydney office of King & Wood Mallesons, with expertise in insurance advice and disputes, commercial real estate disputes, and general commercial litigation.  

In his insurance practice, Peter provides policy response advice and claims support (including litigation, if required) in relation to a range of insurance claims (including claims made under Professional Indemnity, Directors & Officers, Statutory Liability, W&I, cyber, Contract Works insurance, and Industrial Special Risks policies).  The bulk of Peter’s experience has been in the professional indemnity space, often advising other professional services firms.

Peter is often called upon by the banking and finance, mergers & acquisitions and real estate practice groups to provide bespoke advice and views on policy wording, potential claims coverage, or insurance obligations in large contracts (including infrastructure projects).  

Peter has experience in commercial real estate disputes, including recently, helping landlords navigate COVID-related relief granted to tenants in 2020.

Peter is highly regarded as an expert in complex insurance litigation, but he is also experienced in general commercial litigation and dispute resolution having acted for a number of clients in the private equity, banking, real estate, and resources sectors.

Recent Matters

Peter’s matters and clients include:

  • LPLC (and several of Australia’s top tier and mid-tier law firms) – defending top-tier and mid-tier Australian firms in professional negligence claims (including in class actions).
  • Covid-19 advisory - advising a broad spectrum of clients on insurance cover which may be available under Industrial Special Risk policies for losses suffered as a result of COVID-19.
  • Large Australia Financial institutions; acting as a key insurance advisor (with Travis Toemoe) for a big-four bank.
  • Insurance claims for a listed Australian company: advisor to a listed Australian about a range of insurance claims (including Statutory Liability, W&I, and Directors and Officers)
  • London-based reinsurance market: acting in a protracted litigation about a significant Professional Indemnity claim (design & construction).
  • Commercial landlords – representing commercial landlords in disputes with tenants relating to the relief required to be provided under the NSW Regulations.
  • Infrastructure arbitration – advising the Builder of a large infrastructure Australian project in a series of domestic arbitrations, and litigation. Peter works for this client as part of a team at KWM and is focussed on software engineering / design issues.
  • National Australia Bank – with a broad team at KWM, acting in relation to the BBSW regulatory proceedings commenced by ASIC in 2016.
  • Cyber insurance advice - Investigating, managing and submitting a cyber claim for a private equity fund (achieving a recovery of 100% of the principal loss).
  • Overseas insurer – acting for an overseas insurer in a domestic arbitration in Australia.
  • Principal of Morgan Stanley and its directors – acting on a significant joint venture and construction dispute concerning the construction of a diesel storage facility at the Port of Mackay in Queensland. This matter involved allegations of fraud and required the preparation of a significant amount of evidence about the tracing of funds.
  • Commercial litigation for large financial services - including Citibank, Citibank N.A, Morgan Stanley Smith Barney and stockbroking firms regarding margin loans and OTC derivatives.
  • Zurich Financial Services Australia: Strategic advice on policy terms of its insurance program.
