Areas of practice

Mr. Liu Xinyu is a member of Management Committee of King & Wood Mallesons, and he also is the lead partner of the firm’s customs and foreign exchange practice group. He specializes in international trade and dispute resolution, export control, customs compliance (including inspection and quarantine) and foreign exchange compliance and M&A, etc.

With more than 30 years of experience, Mr. Liu has handled and participated in hundreds of cases involving customs, inspection and quarantine, export control, foreign exchange and other import and export supervision matters, international trade compliance and dispute resolution, customs duties related matters for imported and exported goods, commodity classification, country of origin, processing trade, tax reduction and exemption, solid waste, etc. Mr. Liu has assisted enterprises in dealing with administrative penalties and submitting administrative reconsiderations and initiating litigation, represented clients in smuggling and other anti-smuggling cases, and advised clients on foreign exchange control related matters in respect to cross-border capital flows. Mr. Liu has also advised a number of high-tech enterprises on foreign and domestic matters of export control and economic sanctions, assisted enterprises in formulating crisis management measures and solutions, and established and improved relevant compliance systems.

In addition to having acted as legal counsel in a number of important cases with social impact and influence, Mr. Liu has also actively participated in consultation and research related to the formulation of new laws and regulations, and he has been consulted for his legal expertise on various civil and administrative cases.
In the area of corporate/mergers and acquisitions, Mr. Liu has handled hundreds of projects in foreign investment, M&A and corporate reorganizations. Mr. Liu has also represented domestic and overseas clients in a wide range of arbitration proceedings at the China International Economic and Trade Arbitration Commission, the ICC International Court of Arbitration and other arbitration courts, and he has actively promoted the use of alternative dispute resolution methods, such as mediation.

Mr. Liu has been ranked among leading lawyers in the field of “International Trade: Customs, Export Control” in 2021 by Chambers Asia-Pacific Guide. In the same year, Mr. Liu has been named a highly recommended lawyer in the Asia-Pacific region in the field of “WTO/International Trade” by the Legal 500.

Work experience 

Mr. Liu Xinyu joined King & Wood Mallesons in 2005. Before joining King & Wood Mallesons, Mr. Liu worked for a private law firmed based in Beijing. After Mr. Liu completed his studies abroad in Japan, he served as Chinese legal counsel for several years at the headquarters in Japan of a well-known Fortune 500 corporation. 

Mr. Liu received his LL.B. from Fudan University in 1990, majoring in International Economic Law. Mr. Liu also received his LL.M. of Civil Law and International Economic Law in Japan, and while working, Mr. Liu completed a doctoral program in International Economic Law. 

Mr. Liu is an adjunct professor at the graduate school of China University of Political Science and Law, the co-director of the Institute of Customs and Foreign Exchange of Renmin University of China, the co-director of the Cross-border Sanctions and Export Controls Research Center of Beijing Foreign Studies University and a member of the 10th class of the All-China Youth Federation.

Mr. Liu is an arbitrator of the China International Economic and Trade Arbitration Commission (CIETAC), the Japan Commercial Arbitration Association (JCAA), and the Harbin/Wuhan/Dalian Arbitration Commissions.

Mr. Liu is proficient in Chinese, Japanese and English.
