Education systems vary across different countries as do legal systems. Hong Kong follows a common law system while many countries along the Belt and Road follow a civil law or Islamic law structure. Although Hong Kong is renowned for its excellent professional services, does it mean there is no role for Hong Kong to play in this area?
This international law firm headquartered in Hong Kong has worked for clients from the Belt and Road countries and has set up a dedicated Belt and Road group. Legal services they provide include financing and dispute resolution.
Co-Chief Executive of the law firm Hayden Flinn says, “In many cases, the counterparties will be sovereign entities or connected with the local government, and that's one area where Hong Kong’s status really comes into play. Hong Kong can be an independent jurisdiction for the resolution of disputes.”
Hayden said Hong Kong has a lot of legal talent who possess professional knowledge and also understand China, and therefore are able to provide services for Belt and Road projects. Most of the countries along the Belt and Road are emerging economies which are more challenging than mature markets.

這家以香港為總部的國際律師事務所,近年接到一些「一帶一路」國家的生意,設專門小組負責。為客戶提供的服務,包括融資法律諮詢、解決爭端等。
律師事務所聯席首席管理人范凱敦:
「很多個案中,合作時出現糾紛的對象,涉及主權,或與當地政府有關,這正是香港有發揮之處,可擔當紛爭調解的獨立仲裁角色。」
范凱敦說香港不少法律專才,擁有專業知識,同時了解中國,能為「一帶一路」項目提供顧問服務。大部分「一帶一路」沿線國家是新興市場,比成熟市場更具挑戰。
